China Addendum to nVent’s Privacy Statement

本附录是nVent隐私声明(“全球隐私声明”,可在https://www.nvent.com/en-us/privacy-policy#查看)的补充部分,适用于nVent在中国处理您的个人信息或其他适用《中华人民共和国个人信息保护法》(“PIPL”)或中国其他数据保护法的情形。如果全球隐私声明与本附录之间存在任何冲突或不一致,以本附录的条款为准。This Addendum is set out in addition to and forms an integral part of nVent’s Privacy Statement (“Global Privacy Statement”, available at https://www.nvent.com/en-us/privacy-policy#) and will apply to the extent that your personal information is being processed by nVent in China or other circumstances where the Personal Information Protection Law of China (“PIPL”) or any other data protection law in China applies. In the event of any conflict or discrepancy between the Global Privacy Statement and this Addendum, the terms of this Addendum shall govern and prevail.
处理您个人信息的法律依据LEGAL BASIS FOR PROCESSING YOUR PERSONAL INFORMATION
我们可能会根据全球隐私声明中列出的目的收集您的个人信息,处理您个人信息的法律依据基于以下一个或多个法律依据:We may collect your personal information in connection with the purposes listed in the Global Privacy Statement, and the legal basis for processing your personal information is based on one or more of the following legal bases:
  • 在获得相关个人同意的情况下(若您提供其他个人的个人信息,您应当获得其同意);
  • where the consent of the individual concerned is obtained (where you provide personal information of other individuals, you shall obtain their consent to do so);

  • where it is necessary for the conclusion or performance of a contract to which the individual concerned is a party, or for the implementation of human resources management in accordance with the labor rules and regulations formulated in accordance with the law and the collective contract concluded in accordance with the law;

  • where it is necessary for the performance of statutory duties or statutory obligations;

  • where it is necessary for the response to a public health emergency or for the protection of the life, health and property safety of a natural person in an emergency;

  • where such acts as news reporting and supervision by public opinion are carried out for the public interest, and the processing of personal information is within a reasonable scope;

  • where it is necessary to process the personal information disclosed by the individual concerned or other personal information that has been legally disclosed within a reasonable scope in accordance with the PIPL; and

敏感个人信息SENSITIVE PERSONAL INFORMATION
我们在全球隐私声明中列出的所收集个人信息(即支付数据,如信用卡详细信息和账户数据)可能构成PIPL规定的敏感个人信息。一旦泄露或非法使用,可能会对个人权利和利益产生影响,如侵犯人格尊严或对个人或财产安全造成损害。我们将根据全球隐私声明中所述目的,在必要时处理您的敏感个人信息,并在需要时取得您的单独同意。The personal information (i.e. payment data, such as credit card details and account data) we collect listed in the Global Privacy Statement may constitute sensitive personal information under the PIPL. Once leaked or illegally used, it may lead to impacts on personal rights and interests, such as infringement of human dignity or harm to personal or property safety. We will process your sensitive personal information as necessary for the purposes described in the Global Privacy Statement with your separate consent where required.
我们如何共享您的个人信息HOW WE SHARE YOUR PERSONAL INFORMATION
如果我们因全球隐私声明中所述目的与第三方控制者共享您的个人信息,我们将通知您第三方的名称和联系方式、要共享的个人信息类型以及处理和共享个人信息的目的和方式,并取得您事先的单独同意。我们建议您参考第三方控制者的隐私声明以了解他们如何使用您的个人信息。If we share your personal information with third-party controllers for the purposes described in the Global Privacy Statement, we will notify you of the name and contact details of the third parties, the types of personal information to be shared, and the purposes and means of processing and sharing personal information and obtain your prior separate consent. We recommend you refer to the third-party controllers’ privacy notices for information on how they use your personal information.
跨境数据传输(“CBDT”)CROSS-BORDER DATA TRANSFER (“CBDT”)
如果在中国收集或生成的您的个人信息被转移到中国境外,您的个人信息将按照中国法律法规的规定通过适当保障措施加以保护,包括但不限于通过安全评估审批、完成标准合同备案或)由中国主管部门正式公布的个人信息从中国向其他司法管辖区转移的认证(如适用)。Where your personal information collected or generated within China is transferred outside of China, your personal information will be secured by appropriate safeguards as set forth under Chinese laws and regulations, including without limitation, by obtaining approval in security assessment, completion of the standard contract filing or certification (where applicable) officially published by the Chinese authorities for the transfer of personal information from China to other jurisdictions.
根据PIPL的要求,我们将在转移您的个人信息之前通知您与转移相关的信息并取得您的单独同意:To the extent required by the PIPL, we inform you of the relevant information about the transfer and obtain separate consent from you before the transfer of your personal information:

儿童的个人信息CHILDREN’S PERSONAL INFORMATION
我们不会在知情的情况下收集或征求16岁以下儿童的个人信息。如果我们发现我们收集了16岁以下儿童的个人信息,我们将立即从我们的记录中删除该信息。如果您认为16岁以下的儿童可能向我们提供了个人信息,请按照全球隐私声明的“联系我们”部分中的方式与我们联系。We do not knowingly collect or solicit personal information from children under the age of 16. If we become aware that we have collected personal information from a child under the age of 16, we will promptly delete the information from our records. If you believe that a child under the age of 16 may have provided us with personal information, please contact us as specified in the CONTACT US section of the Global Privacy Statement.
